What is a magistrate judge?

A magistrate judge is a judicial officer of the District Court who handles all civil and criminal court cases filed in state court, except civil disputes over $10,000 in value, quiet title actions, declaratory judgments, and felony criminal cases after the preliminary hearing stage. Magistrate judges provide judicial services 24 hours a day, seven days a week

How does a person become a magistrate judge?

All magistrate judges are lawyers chosen by a magistrate’s commission comprised of judges, elected officials, legislators, local attorneys, and citizens from the judicial district they serve. Once appointed, a magistrate judge serves a four-year term followed by a non-partisan retention election every four years after that.

How was Diane Walker appointed as an Ada County magistrate judge?

After practicing law for over 16 years in Washington and Idaho, she submitted her application to become a magistrate judge, supported by letters of recommendation. The Idaho State Bar then distributed a survey to attorneys. Once the survey was completed, the Commission reviewed all applications, recommendations, survey results, and public comments. Following this review, the Commission decided to interview a select group of candidates. Ultimately, Diane Walker was chosen to be the next Fourth District Magistrate Judge serving Ada County and was sworn in on July 1, 2014. 

How was Diane Walker appointed as an Ada County magistrate judge?

Diane Walker completed her 18-month probationary period and was retained in both the 2016 and 2020 elections. She has had no disciplinary actions taken against her by the Idaho Judicial Council. Although she has attempted twice to be appointed to the Idaho Supreme Court and her name was forwarded as a finalist by the Council, Governor Little appointed other well-qualified women to the position instead. Diane has devoted the majority of her career to protecting families and children. She is honored to continue serving as a magistrate judge for the citizens and litigants of Ada County and the State of Idaho, specializing in family law and domestic violence.
